1. Acceptance of Terms
Capsele Inc. ("we," "our," or "us"), a Delaware corporation, operates the Capsele mobile application and website at www.capsele.world. By downloading, installing, or using the Capsele mobile application ("App") or accessing our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or website.
2. Description of Service
Capsele is a bilingual audiobook app that allows users to listen to stories in multiple languages. The App offers both free and premium features. Subscriptions can be purchased through the Apple App Store or directly through our website.
3. Account Registration
To use the App, you must create an account using an email address, Apple ID, or Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscriptions and Payments
Subscription Plans
Capsele offers premium subscriptions with the following plans:
- Monthly – billed every month
- Quarterly – billed every 3 months
- Yearly – billed every 12 months
Purchases Through the Apple App Store
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price. You can manage and cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions). Refund requests for App Store purchases are handled by Apple in accordance with their refund policy.
Purchases Through Our Website
If you purchase a subscription through www.capsele.world, payment is processed by Wix Payments or other third-party payment processors. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can manage and cancel your subscription through your account on our website. Refund requests for website purchases can be submitted by contacting us at support@capsele.world.
Cross-Platform Access
A subscription purchased through either the App Store or our website grants access to premium features across the App. Your subscription status is linked to your Capsele account.
Enterprise and Institutional Access
Capsele may also be made available through schools, educational institutions, or other organizations ("Institutions") under an enterprise agreement. In such cases, the Institution purchases access on behalf of its users (e.g., students, teachers, or staff). The Institution may provide us with user names and email addresses to set up accounts. We process this data on behalf of the Institution and in accordance with our agreement with them. If you access Capsele through an Institution, your Institution's privacy policy may also apply. Please contact your Institution for details about how they handle your data.
5. Free and Premium Features
- Free features: NFC book scanning, listening to scanned books, basic playback
- Premium features: Book browsing and discovery, offline library, access to full book catalog
Premium features may be unlocked through an App Store subscription, a website subscription, or through access granted by an Institution (e.g., a school or organization) under an enterprise agreement.
6. Content and Intellectual Property
All book content, including text, audio recordings, and illustrations available through the App, is owned by or licensed to Capsele. You may not reproduce, distribute, or create derivative works from this content without our written permission.
Your use of downloaded content is for personal, non-commercial purposes only.
7. User Conduct
You agree not to:
- Share your account credentials with others
- Attempt to reverse engineer or extract content from the App
- Use the App for any unlawful purpose
- Interfere with the operation of the App or website
8. Account Deletion
You may delete your account at any time through the App (Settings > Delete Account). This will permanently delete your account data, library, and downloaded content. Active subscriptions must be cancelled separately — through Apple's settings for App Store purchases, or through your account on our website for direct purchases.
9. Disclaimer of Warranties
The App and website are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the maximum extent permitted by law, Capsele shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App or website.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date. Your continued use of the App or website after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
